This rationale is implemented by making use of several methodical approaches. Through this, § 613a Abs. 1 S. 2–4 BGB provides a consequent and practical system. The key to the here developed interpretation line is the legal form of the normative provisions of collective agreements after the transfer of business as content of the employment relationship and the perpetuation of its collective character.
Mit der Weitergeltung tarifvertraglicher Normen nach dem Betriebsübergang gehen zahlreiche praxisrelevante Probleme einher, die eine starke Rechtsunsicherheit hervorrufen und schon deswegen stringenter Lösungen bedürfen.
Die Autorin arbeitet die Grundfragen rund um die Weitergeltung des Tarifvertrags auf und zeigt durch Einpassung des § 613a Abs. 1 S. 2–4 BGB in das Tarifrecht, wie sich konsequente und sachgerechte Lösungen dieser Probleme entwickeln lassen, die nationalen und europäischen Anforderungen Rechnung tragen.
