englischThe question of responsibility for copyright infringements on the internet is omnipresent. In most cases, rights holders attack the technical infrastructure of websites whose business model is based on copyright infringements. The fact that the existence of structurally copyright-infringing websites is largely dependent on the financing of advertising has been little discussed to date, which suggests a comprehensive investigation into the liability of advertisers and advertising intermediaries. The path leads via the European requirements – in particular the case law of the European Court of Justice on communication to the public – and the application of publicity obligations in copyright law to a generally applicable liability model for copyright infringements on the internet.
