englischThe housing issue is one of the central topics of our society. In order to protect existing tenants from displacement, the transfer of housing stock to common ownership is being discussed in Berlin. The basis is to enact a law according to Art. 15 GG.
The author analyzes whether and under what conditions the transfer of housing stock into common ownership is possible under the Basic Law. For this purpose, he elaborates the (remaining) scope of application of Art. 15 GG and classifies it in the structure of the Basic Law. The relevance of proportionality is also discussed, as well as the question of the amount of compensation to be paid. The work is rounded off with a presentation of the question of the authority to intervene for the state of Berlin.
Die Wohnraumfrage ist eines der zentralen gesellschaftlichen Themen. Um die Bestandsmieter vor Verdrängung zu schützen, wird in Berlin die Überführung von Wohnungsbestand in Gemeineigentum diskutiert. Grundlage soll ein Gesetz nach Art. 15 GG sein.
Anknüpfend daran analysiert der Autor, ob und unter welchen Voraussetzung die Überführung von Wohnungsbestand in Gemeineigentum zulässig ist. Dazu arbeitet er den (verbleibenden) Anwendungsbereich des Art. 15 GG heraus und ordnet diesen im Gefüge der Grundgesetzes ein. Ebenfalls wird die Relevanz der Verhältnismäßigkeit diskutiert sowie die Frage, in welcher Höhe Entschädigungen zu zahlen sind. Die Arbeit wird mit einer Darstellung zur Frage der Eingriffsbefugnis für das Land Berlin abgerundet.
