englischThe housing issue is one of the central topics of our society. In order to protect existing tenants from displacement, the transfer of housing stock to common ownership is being discussed in Berlin. The basis is to enact a law according to Art. 15 GG.

The author analyzes whether and under what conditions the transfer of housing stock into common ownership is possible under the Basic Law. For this purpose, he elaborates the (remaining) scope of application of Art. 15 GG and classifies it in the structure of the Basic Law. The relevance of proportionality is also discussed, as well as the question of the amount of compensation to be paid. The work is rounded off with a presentation of the question of the authority to intervene for the state of Berlin.
