englischThe work analyses the typification in consumer law. Does it follow a rule? The study questions the compatibility of typification in consumer law with the constitutionally protected freedom of contract and proposes a new approach. However, this must overcome national borders, as European law determines the consumer law systems of the Member States. The thesis therefore examines the extent to which it is possible to reconcile the new approach of typification with Union law. Can European consumer protection ultimately lead to constitutional typification? The author holds a professorship for commercial law at the FOM University of Applied Sciences in Düsseldorf.
Die Arbeit analysiert die Typisierung im Verbraucherrecht. Folgt diese einer Regel? Die Untersuchung stellt die Vereinbarkeit der Typisierung im Verbraucherrecht mit der grundrechtlich geschützten Vertragsfreiheit in Frage und schlägt einen neuen Ansatz vor. Dieser muss aber die nationalen Grenzen überwinden, determiniert doch das Europarecht die mitgliedstaatlichen Verbraucherrechtsordnungen. Deshalb untersucht die Arbeit, inwieweit es möglich ist, den neuen Ansatz der Typisierung mit dem Unionsrecht in Einklang zu bringen. Kann letzten Endes europäischer Verbraucherschutz zu verfassungskonformer Typisierung führen? Der Autor ist Inhaber einer Professur für Wirtschaftsrecht an der FOM Hochschule in Düsseldorf.
