Das Antidiskriminierungsrecht spielt insbesondere im deutschen Arbeitsrecht eine herausragende Rolle. Weitreichende Auswirkungen hat dabei die Europäische Grundrechtecharta.
So enthält Art. 21 Abs. 1 der Charta umfassende Diskriminierungsverbote, die seit dem Vertrag von Lissabon rechtlich gleichrangig mit den Europäischen Verträgen sind. Anhand der Rechtsprechung des Europäischen Gerichtshofs und der Unterlagen des Grundrechte-Konvents analysiert Antoinette von Diest die Bindungswirkung der Charta. Sie kommt zu dem Ergebnis, dass diese deutlich weiter reicht als bislang angenommen und grundsätzlich auch Private erfassen kann.
Die Autorin untersucht eingehend die in Art. 21 der Charta enthaltenen Diskriminierungsmerkmale und zeigt auf, dass diese nicht nur hinsichtlich des Anwendungsbereichs, sondern auch in inhaltlicher Hinsicht an maßgeblichen Stellen über den im deutschen Recht bislang geltenden Schutz hinausgehen.

Antoinette von Diest analyses the binding force of Art. 21 of the Charta by assessing the jurisdiction of the European Court of Justice and the materials of the Convention on Fundamental Rights. She comes to the conclusion that the scope of application is much broader than assumed. Art. 21 of the Charta may in general be applicable to private persons as well.
The author thoroughly examines the grounds of discrimination contained in Art. 21 of the Charta. In significant areas, they go beyond the protection of German law as of today.
