Warum braucht es besondere Regelungen im Recht des Beschäftigtendatenschutzes? Zur Beantwortung dieser grundlegenden Metafrage nimmt der Autor nach Darstellung des gesetzlichen Status quo eine Analyse traditioneller sowie moderner Begründungsansätze für das Datenschutzrecht an sich vor. Besonderen Wert legt er auf den Datenschutz durch Privatautonomie sowie auf Argumente der ökonomischen Analyse des Rechts. Auf diesem dogmatischen Fundament aufbauend arbeitet er beschäftigungsspezifische Sonderkonstellationen heraus – nur dort, wo das Beschäftigungsverhältnis besonders ist, bedarf es gesonderter Regelung.
Mit den gewonnenen Erkenntnissen werden aktuelle Problemfelder des Beschäftigtendatenschutzes, die sich gerade im Zuge der neuen Datenschutz-Grundverordnung stellen, behandelt – sei es die Einwilligung, die Videoüberwachung oder der Beschäftigtenbegriff selbst.

In particular, data protection through private autonomy, the Anglo-American right to privacy and arguments of the economic analysis of law are transferred to employee data protection – only if special constellations are found, special regulations are needed. Based on the general results, the most discussed issues in employee data protection are discussed; they become even more pressing in consideration of the new General Data Protection Regulation: employees’ consent, video observation or the personal scope of employee data protection.
