Viele Konzerne operieren in einer Matrixorganisation. Diese ist dadurch gekennzeichnet, dass die Konzernunternehmen von funktions- und produktbezogenen Geschäftsbereichen überlagert werden, die rechtsträgerübergreifend von sog. Matrixmanagern gesteuert werden.
In ihrer Dissertation untersucht die Verfasserin, ob angesichts dieser Besonderheiten eine Neuinterpretation des Betriebsbegriffs geboten ist. Eine systematische Analyse der Ordnungsprinzipien der Betriebsverfassung sowie der rechtlichen Grundlagen der Matrixorganisation im Konzern ergibt, dass die Lösung für die auftretenden Probleme im Rechtsinstitut der Stellvertretung zu suchen ist. Die funktionalen Organisationseinheiten der Matrixorganisation sind nur ausnahmsweise als virtuelle „Matrixbetriebe“ anzuerkennen, die neben die herkömmlichen Betriebe der Konzernunternehmen treten. Ausgehend von diesen Erkenntnissen wird die Betriebszugehörigkeit der Arbeitnehmer und der Matrixmanager erörtert.

In her dissertation the author examines whether the specific characteristics of the matrix organisation require a reinterpretation of the definition of a plant in the sense of the German Works Constitution Act. Based on a systematic analysis of the organising principles of the works constitution and the legal concept of the matrix organisation in a group of companies the author points out that the solution for the identified problems may be found in the legal principles of representation. The organisational units of the matrix organisation are to be recognized only in exceptional cases as virtual „matrix plants“ in addition to the conventional plants of the group companies. Based on these conclusions the author analyses the employees‘ and matrix managers‘ staff membership in a plant.
