Traditionell geht es bei der Analyse des Eigentumsgrundrechts vor allem um öffentlich-rechtliche Fragestellungen. Hingegen stand die Bedeutung des Eigentumsgrundrechts im Privatrecht bislang kaum im Fokus wissenschaftlicher Forschung. Der Sammelband greift dieses Thema auf und behandelt die sogenannte horizontale Dimension des Eigentumsgrundrechts.
Die Beiträge des Sammelbandes erörtern unter anderem den öffentlich- und den privatrechtlichen Eigentumsbegriff aus historischer Perspektive und verdeutlichen die einschlägigen Konvergenzen und Divergenzen. Zudem beschäftigen sich die Beiträge anhand von Beispielen aus dem Nachbar-, Miet-, Wohnungseigentums- und Insolvenzrecht mit den Auswirkungen des Eigentumsgrundrechts auf das Privatrecht. Dabei wird insbesondere untersucht, inwieweit Art. 14 GG die Lösung von Rechtsfragen oder Rechtsstreitigkeiten in privatrechtlichen Beziehungen determiniert.

englischThe scholarship relating to Art. 14 German Grundgesetz focuses traditionally on public law issues. The relevance of the constitutional right to property on private law has been mostly neglected in academic research. The volume sheds light on this issue by analysing the impact of Art. 14 Grundgesetz on relationships among individuals or private entities.
The contributions illustrate the convergences and discrepancies of the concept of property in public and private law from a historical perspective. Furthermore, the essays examine the impact of the constitutional right to property on private law by analysing examples taken from the law concerning the respective interests of neighbours, tenancy law, residential property law and insolvency law. The examples focus on the question of how Art. 14 Grundgesetz affects legal issues and disputes in private law contexts.
