Die Forschungsfrage, ob der Verordnungsgeber eine Handlungspflicht besitzt, aufgrund derer er in Bezug auf die Bewegungsmöglichkeit von landwirtschaftlich genutzten Tieren allein konkretisierende Haltungsanforderungen auf Verordnungsebene zu erlassen hat, wird mit „ja“ beantwortet. Selbstverpflichtungen der Wirtschaft sind keine äquivalente Erfüllungshandlung, wenn ein evidenter Verstoß gegen das Untermaßverbot vorliegt. Begründet wird dies mit dem Tierschutzgesetz i.V.m. dem Staatsziel Tierschutz. Eine Verordnung, die nicht den Anforderungen des Tierschutzgesetz entspricht, verstößt gleichzeitig gegen das Staatsziel. Auf verordnungsrechtlicher Ebene ist auch ein ausdrückliches Verbot einer Haltungsform möglich.

Codes of conduct by the economy are not an equivalent act of performance if there is an evident violation of the prohibition of undersize. This is justified by the Animal Welfare Act in conjunction with the state objective of animal welfare. A regulation that does not meet the requirements of the Animal Welfare Act also violates the state objective. At the regulatory level, an explicit ban on a form of husbandry is also possible.
